Israel heeft niet het recht op zelfverdediging tegen vrijheidsstrijders uit het gebied dat Israel zelf bezet en onderdrukt.

” Under the terms of Article 51 of the Charter of the United Nations:
«Nothing in the present Charter shall impair the inherent right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security.»
Article 51 of the Charter thus recognizes the existence of an inherent right of self-defence in the case of armed attack by one State against another State. However, Israel does not claim that the attacks against it are imputable to a foreign State.
The Court also notes that Israel exercises control in the Occupied Palestinian Territory and that, as Israel itself states, the threat which it regards as justifying the construction of the wall originates within, and not outside, that territory. The situation is thus different from that con templated by Security Council resolutions 1368 (2001) and 1373 (201l), and therefore lsrael could not in any event invoke those resolutions in support of its claim to be exercising a right of self-defence.
Consequently, the Court concludes that Article 51 of the Charter has no relevance in this case.

The siege in itself is a war crime, said the rights group, and must be stopped by the international community in order to save the lives of civilians in Gaza, who are supposed to be protected under international humanitarian law.”
Euromed heeft geen twijfel over de toepasselijkheid van de kwalificatie van “genocide”. (Terecht, ook al is nog niet iedereen daar vermoord, contra Timmermans bij Buitenhof enkele weken geleden, want de Genocide Conventie stipuleert ook dat de destructie van een bevolking met verklaarde intentie neerkomt op genocide ook al is die “in part”). “Israel is clearly hellbent on making a cautionary tale out of Gaza, to terrorize, punish, humiliate and crush its population to make an example out of them that forces Palestinians in the entire occupied territories into submission” Mr. Abdu added. “Israel’s campaign is designed to leave permanent mental and physical damage on most of Gaza’s population and create conditions that render the enclave incapable of sustaining organized human life.”
“Euro-Med Monitor concludes that even if the war were to end today, it would take decades before Gaza is restored to its pre-October 7 status quo, which was already an unlivable and unsustainable environment.”

Het absolute nulpunt van de Nederlandse televisiejournalistiek.

“Ik heb het over uw bewering dat Israel het grond gebied van Gaza wil hebben. Maar dat is NIET het Israelische beleid.” Jeroen Wollaars in “gesprek” met VN Special Rapporteur voor de Palestijnse Gebieden, Francesca Albanese, op Nieuwsuur gisterenavond.

Met deze nul is toch echt het absolute nulpunt de Nederlandse televisiejournalistiek bereikt. Waarom ze deze zelfingenomen sukkel ooit een Sonja Barendprijs voor interviewen hebben kunnen geven, is mij een raadsel. Of nee, misschien toch niet. Nederland is het land van de onwetendheid en de onverschilligheid bij uitstek –– dáárom kan het ook altijd zo uitblinken in hypocrisie. En als domineetjes denken veel van de Nederlandse “opinieleiders” altijd de waarheid te weten. Ook al verzinnen ze veel van wat ze zeggen zelf.

“U zei ook dat de Israëliërs de Palestijnen uit Gaza drijven zodat zij het land kunnen innemen,” werpt Wollaars de juriste voor. “Hebt u bewijs dat dat ook regeringsbeleid is?” –– Kritisch hoor, Jeroen. En nadat ze heeft gewezen op de veelheid aan verklaringen en van bewijzen in de praktijk, protesteert hij dat er toch ook netjes –– want dat is de toon –– humanitaire hulp is geleverd. En dat, o gotspe, de VS zo goed als “rode lijnen” heeft getrokken om Israel zich ietsje te laten inhouden. Heeft het in deze context dan zin om radicale uitspraken te doen?” Dan breekt Albanese’s klomp: “Zijn mijn uitspraken radicaal? Pardon, maar heeft u wel gehoord wat het hoofd van de WHO heeft gezegd? Het hoofd van UNWRA, van Unicef, van het Rode Kruis? Hebt u hun uitspraken gehoord? Want zij zitten in Gaza. En zij zeggen dat het apocalyptisch is, dat ze nog nooit zoiets hebben gezien. Waarom zegt u dat mijn opmerkingen radicaal zijn? Weet u wat pas radicaal is? De mate van ontkenning in de Westerse wereld. Dat gaat mijn verstand echt te boven.”

Dan denk je dat Wollaars inmiddels wel terug in zijn hok is gegaan, van schaamte over zijn eigen, beledigende stupiditeit, maar neee, hij doet er nog een schepje stommiteit bovenop.

“Ik heb het over uw bewering dat Israel het grond gebied van Gaza wil hebben. Maar dat is NIET het Israelische beleid.” En Wollaars kan het weten want dat zal hij van Netanyahu’s mensen hebben gehoord. Of van Rutte. Uiteraard heeft Albanese een passend antwoord, maar het zal Wollaars waarschijnlijk worst wezen. Van “settler colonialism” heeft hij blijkbaar nooit gehoord. Hij weet niks van de hele problematiek ! En het maakt hem blijkbaar weinig uit –– hij weet immers wat de persvoorlichters van Israel, de VS, de EU en Nederland hebben gezegd, is op de hoogte van de standpunten van het CIDI en wellicht ook van Femke Halsema.

Bovendien had hij in zijn aankondiging van het interview reeds gezegd dat Albanese “een niet onomstreden jurist” was, “die eerder moest terugkomen op uitspraken over de, haar citaat, «Joodse lobby in Amerika». Uit angst voor de associatie met het door de nazi’s uitgevente beeld van de “internationale J***se samenzwering, durft nu niemand meer toe te geven dat ALLE politiek in de westerse democratieën wordt beïnvloed door de actieve sturing door lobbygroepen, of dat nu Shell is of het MKB (zie noot). Trouwens, het CIDI wordt voortdurend een podium gegeven om de problematiek van antisemitisme in Nederland aan te kaarten. Hun “monitor” is voor Nederlanders normgevend. Maar het CIDI is gekoppeld aan de STAAT Israel –– de naam zegt het al: “Centrum Informatie en Documentatie Israël”. Kritiek op de staat Israel zal evenwel worden gezien als “antisemitisme” door iedereen die de verklaring van de International Holocaust Rememberance onderschrijft, waarvoor het CIDI, surprise surprise, dan ook pleit. Dat is toch ook bewijs van een bedenkelijke lobby? –– maar met deze opmerking zal ik me ontvankelijk maken voor de aantijging antisemitisch te zijn. Maar kritiek hebben op het handelen van de Staat Israel, het politieke Zionisme, de Likoed Partij en de vergoeilijking ervan is niet antisemitisch, in weerwil van de IHRA verklaring. Er zijn zat Joodse mensen die kritiek hebben op Israel (en die dan “zelfhaters” worden genoemd, zoals de talloze journalisten en historici die ik veelal aanhaal (Ilan Pappé, Avi Schlaim, Gideon Levi, Norman Finkelstein, Sara Roy, Thomas Suárez, etc.), zoals ook de grote groep orthodoxe rabbi’s in de VS. Ik verwijs verder naar bijvoorbeeld Jaap Hamburger’s Een Ander Geluid, of The Rights Forum, of Jewish Voices for Peace, of B’Tselem etc.

Wollaars is dus ook al vooringenomen met zijn interview begonnen. Nederlandse televisiejournalisten lijken hoe dan ook kennelijk opgeleid te zijn slechts als persconferentievolgers die dan ook alles wat persvoorlichters van welke regering of leger voorschotelen voor waar aannemen.

Ik hoop een transcriptie van dit interview te maken, zodra ik er weer tegen kan dit gênante interview opnieuw aan te horen. Want dit dieptepunt, zo typerend voor Nederland, moet worden gedocumenteerd!

Voorwendselagressie

Geschiedenis herhaalt zich weliswaar niet, maar er vormen zich soms toch wel patronen. –– om maar eens op de toer van Het Historisch Nieuwsblad te gaan.

Vanmorgen las ik weer stuk in “Palestine. Peace Not Apartheid“, het boek van Jimmy Carter, de enige president van de VS die zich het lot van de Palestijnen werkelijk heeft aangetrokken. Hij herinnert zich hoe, in maart 1978, Palestijnse strijders vanuit een basis in het zuiden van Libanon een aanval uitvoerden op Israel. “A sightseeing bus was seized and thirty-five Israelis were killed. I publicly condemned this outrageous act, but my sympathy was strained three days later when Israel invaded Lebanon and used American-made antipersonnel cluster bombs against Beirut and other urban centers, killing hundreds of civilians and leaving thousands homeless. I considered this major invasion to be an overreaction to the PLO attack, a serious threat to peace in the region, and perhaps part of a plan to establish a permanent Israeli presence in Southern Lebanon. Also, such use of American weapons violated a legal requirement that armaments sold by us be used only for Israeli defense against an attack.” (Jimmy Carter, “Palestine. Peace Not Apartheid“, Simon & Schuster, New York et. 2006, 44). 

De aanleiding tot was dus de fatale afloop van een gijzeling die op 11 maart 1978 bij Haifa werd gepleegd door een Palestijnse commandogroep die via zee was geïnfiltreerd. Vrijwel onmiddellijk na het incident werden talloze doelen in het zuiden van het Libanon gebombardeerd, waaronder de haveninstallaties van Tyrus en het internationale vliegveld van Beiroet. Ook werden overal doelen door Israelische artillerie bestookt. Tienduizenden Israeli vielen drie dagen later Libanon binnen om in de weken daarna “te opereren” in het gebied tot aan de rivier de Litani (vanwaar de naam “Operatie Litani”).  “Naar de woorden van Minister Weizman”, lees je in de krant, “wil Israël het gebied ten zuiden van de Litani-rivier «voor eens en voor altijd zuiveren van terroristen» (“Israeli’s zuiveren het zuiden van Libanon”, Nederlands Dagblad, 16 maart 1978 (https://resolver.kb.nl/resolve?urn=ddd:010682231:mpeg21:a0001). De internationale gemeenschap heeft het dan liever, met Israel zelf, over de creatie van “een veiligheidszone” (De Telegraaf, 16 maart 1978,pagina 11, https://resolver.kb.nl/resolve?urn=ddd:011199299:mpeg21:a0446). 

De toenmalige premier van Israel, Menachim Begin, “verklaarde dat de massale Israëlische actie, die in de nacht van dinsdag [14 maart] op woensdag begon, geen wraakneming was voor de Palestijnse terreuraanval van zaterdag [11 maart], maar een daad van gerechtvaardigde zelfverdediging. Deze zelfverdediging werd een dwingende noodzaak voor Israël, nadat de PLO bij monde van haar leider Arafat, die ook de verantwoordelijkheid voor de terreuractie van zaterdag had opgeëist, had aangekondigd dat dit maar het begin van een grootscheepse terreur-campagne tegen Israël was” (De Telegraaf, 16 maart 1978, pagina 1, https://resolver.kb.nl/resolve?urn=ddd:011199299:mpeg21:a0446).

Tenminste twee vluchtelingenkampen die in 1949 waren opgezet door het Internationale Rode Kruis werden flink getroffen: “Volgens verslaggevers lieten Israëlische Phantoms bommen vallen op de Palestijnse vluchtelingenkampen Sabra en Chatlia [sic.] aan de zuidelijke rand van Beiroet”. (Enige jaren later, in September 1982, zouden hier de beruchte bloedbaden van Sabra en Shatila plaatsvinden, met duizenden slachtoffers,  die aangericht werden door de Maronitische Hobeika militie in samenwerking met het Israelische leger.) Operatie Litani zou het leven kosten aan zeker 2.000 Palestijnen c.q. Libanezen en 20 Israëliërs. Zo’n 250.000 burgers werden uit het gebied verdreven, de rivier over, en de gewelddadigheden in de regio zouden voortduren, nu alleen met een VN vredesmacht (UNIFIL) in het gewoel (Ilan Pappé, The Biggest Prison on Earth. A History of the Occupied Territories, Londen 2017, 158).

De Egyptenaren stelden dat Israel, in het citaat van voornoemd krantenbericht, “«de beginselen van het internationaal recht en het handvest der Verenigde Naties schendt»”. De Syriërs verklaarden op hun beurt “te weten dat Israëlische aanval bedoeld was om het Palestijnse volk te vernietigen”. Westerse landen uitten zoals gewoonlijk hun “bezorgdheid”. 

Hier zien we, als parallel met hetgeen nu gebeurt in de actualiteit, de modus operandi van de Staat Israel: de Israeli staan gewoonlijk paraat om een aanval van de tegenstander, ogenschijnlijk of werkelijk “onverwachts”, onmiddellijk als excuus aan te wenden om een militair goed uitgewerkt plan van actie te implementeren. Zo schreef Ilan Pappé over de busgijzeling dat de PLO, die bedoeld zou zijn geweest om te protesteren tegen hun uitsluiting van deelname aan de vredesonderhandelingen tussen Israël en de Arabische buurlanden onder bemiddeling van de VS (Camp David), “executed an operation that went badly wrong, ending with the death of thirty-five Israeli citizens. This botched operation gave the Israeli army the ostensible reason to occupy southern Lebanon and meddle in the Lebanese civil war (which had broken out three years earlier) by creating its own militia there, the Southern Lebanese Army (SLA), after completing the occupation of southern Lebanon up to the Litani River.” (Ilan Pappé, op.cit. 158). Pappé schrijft de strategie van, zullen we het zo noemen, deze «voorwendselagressie» [mijn woord: zie eindnoot] toe aan Ariel Sharon (ibid., 158ev.)  Merk op dat ook Jimmy Carter de in zijn ogen buitensporige reactie van de Israeli op de busgijzeling en de dreigementen zag als “perhaps part of a plan to establish a permanent Israeli presence in Southern Lebanon” (zie het citaat hierboven, Carter, op. cit. 44).

Het Hoger Onderwijs van de Palestijnen is, zoals verwacht, overal verstoord. Gebouwen zijn verwoest. In de Bezette gebieden van de Westeover zitten de studenten thuis of in de gevangenis. In Gaza delen ze het gezamenlijk lot van de bevolking. “The president of the Islamic University of Gaza Prof. Sufian Tayeh and his family were killed in Israeli bombing in North Gaza (Jabalya) today 2 December 2023. On 12 November 2023, Professor Mohammad Eid Shubair, his wife Rehab, their daughter-in-law Najat Ayoub Alhelo, and their eldest son, Muhammad Malik Shubair in an Israeli airstrike on their home in the vicinity of the Al Shifa hospital in Gaza City. Thousands of academics are injured and most are unable to receive treatments with open wounds due to the collapse of the health care system.”

De Palestijnse geschiedenis wordt uiteraard ook moedwillig uitgewist, net als 75 jaar geleden tijdens het begin van de Nakba. Het Israelische leger gaat er prat op “slechts” twee burgers te hebben gedood per gewapende Hamas strijder. Qumsiyeh gaat hier tijdens een radiointerview op in (verwijzing hieronder). Zelfs als die verhouding zou kloppen, dus dat er zo’n 5000 strijders zouden zijn gedood en 10.000 burgers, dan nog is dat naar eigen zeggen meest “morele” leger ter wereld tevreden met een percentage “collateral damage” van 67%. Maar waarschijnlijk zullen ze slechts zo’n 500 van die strijders hebben gedood. Dat zullen pas weten na vele jaren. In ieder geval is er geen enkel bewijs nog getoond van verslagen strijders.
“For the life of me, I don’t understand why so many countries are silent on this, on an ongoing holocaust, an ongoing genocide,” verzuchtte Qumsiyeh tijdens een radiointerview op 5 december. “You have to understand, we live in a colonial system, run by the most radical extremist racist group of people. They put the nazis to shame, basically, by the attitudes they have towards dehumanising the Palestinians. The attitude that they have that says «there are no Palestinian civilians», that we are human animals. Onevenwichtige berichtgeving

De televisiebulletins van vanmorgen berichtten (terecht) over de aanslag op Israelische burgers bij een bushalte aan de Weizmann Boulevard in Jerusalem door twee broers uit Oost-Jerusalem. De twee “terroristen” zijn doodgeschoten door soldaten en een gewapende “burger” (“Three Killed, Six Wounded in Jerusalem Terror Attack” , Ha’aretz, 30 November 2023: https://www.haaretz.com/…/0000018c-1e28-db78-adcc….
Volgens de Israelische binnenlandse veiligheidsdienst, Shin Bet, zouden de twee broers uit Oost-Jerusalem, Fatah-gebied, leden zijn geweest van Hamas. Dat komt –– waar of niet waar –– Netanyahu goed uit (update 1800u: inmiddels zou hamas de aanslag hebben opgeëist). Want met deze gewapende uitval vanuit Oost-Jerusalem (=Palestijns gebied dat onder grote druk van de bezetter staat) hebben de Israeli een voor zichzelf geldig excuus om ook de gehele Westoever te gaan bombarderen. Ze waren daar natuurlijk al druk mee bezig de afgelopen jaren. De intensiteit van hun aanvallen op de onderdrukte bevolking van bezet Palestina was sinds 9 october sterk toegenomen. En dan kunnen ze nu waarschijnlijk straffeloos nog meer te keer gaan want, zo is nog steeds de misvatting, de staat Israel zou het recht hebben op zelfverdediging tegen de opstandelingen in het door Israel zelf illegaal bezette gebied. [Let op: de twee broers mochten worden uitgeschakeld om directe zelfverdediging te realiseren; maar collectieve straffen ter vergelding elders en reeds ná de uitschakeling van de directe dreiging mag niet.] Ik heb de afgelopen weken sterk de indruk gehad dat de druk door de Israeli bewust zo sterk werd opgevoerd om een tegenactie van Palestijnen op Israelisch “grondgebied” (1967 indachtig) uit te lokken.
Want hebben we op het nieuws gisteren en vanochtend ook genoeg gehoord over de moordpartijen die Israel heeft uitgevoerd in plaatsen als Jenin, Tulkarm, Masafa Yatta etc? En de implicaties van de vergeldingsacties in Gaza? Ik licht twee berichten uit, specifiek nu eens gelet op de moord op minderjarigen.

2. In het vluchtelingenkamp van Jenin op de Palestijnse Westoever, intussen, hebben de commando-eenheden van het bezettingsleger tijdens hun zoveelste razzia twee kinderen op straat geëxecuteerd. Ze waren 8 en 15 jaar oud. Het staat op video: de jongens waren zichtbaar ongewapend (“Israeli forces kill two Palestinian children in occupied West Bank raid Residents of Jenin camp, which has seen nightly raids since October 7, say they were ‘shocked’ at scale of attack.”, Al Jazeera, 29 November 2023).
Dergelijke gevallen van kindermoord staan niet op zichzelf maar maken deel uit van een systematiek die door de bezetters al decennia lang wordt uitgevoerd. “Between September 2000 and October 6, 2023, DCIP [Defense for Children Palestine] independently verified that Israeli forces and settlers killed 2,187 Palestinian children throughout the occupied West Bank, including East Jerusalem, and the Gaza Strip” (https://www.dci-palestine.org/4237_palestinian_children…).
Er is genoeg bewijsmateriaal van moedwillige kindermoord door Israeli in de Palestijnse gebieden te vinden in de rapporten van de verschillende onderdelen van de VN, Al-Haq, B’Tselem, Yesh Din, Amnesty International, Human Rights Watch en, inderdaad, voornoemde NGO Euro-Med Human Rights Monitor. Naar aanleiding van een opiniestuk van Jonathan Cook in The Middle East Eye van gisteren heb ik vandaag twee zaken om te bespreken: een bezwaar tegen het gebruik van het woord “gevangenen”  in de huidige context van de ruil van gijzelaars; en een bezwaar tegen de in het westen dominante uitleg van de leus “From the River to the Sea etc”.

Deel 1. De ruil van gijzelaars

Er zouden weer Israëlische “gijzelaars” zijn geruild voor Palestijnse “gevangenen.” Uit de woordkeuze blijkt de partijdigheid. Hier wordt het beeld opgeroepen van een contrast tussen, aan de ene kant, gijzelaars die hun lot niet te danken hebben aan een eigen handelen of nalaten, en, aan de andere kant, mensen die zouden zijn gearresteerd, aangeklaagd en uiteindelijk veroordeeld door een rechter omdat ze kennelijk iets op hun kerfstok hadden. Think again. Israëlische militairen stormen bijna dagelijks de gebieden van de Palestijnse Staat binnen om mensen in gijzeling te nemen, veelal vrouwen en kinderen, om ze zonder verdere rechtsgang voor onbepaalde tijd op te sluiten. De “gevangenen” worden vastgehouden in wat men eufemistisch “administrative detention” noemt (“bestuurlijke detentie”), dat wil zeggen, willekeurige opsluiting (zoals de VN dat noemt) met een vervaltermijn van zes maanden  die steeds weer ongemerkt wordt verlengd naar Israelisch-militair goeddunken. Daar schuilt groot leed achter voor vele duizenden Palestijnen. Deze gijzelaars namelijk leven in grote onzekerheid onder slechte omstandigheden. Ze ondergaan vaak mishandelingen die soms ook fataal aflopen. Ook ondergaan ze doorgaans een totale ontzegging van medische bijstand, bezoekrecht, rechtshulp enzovoorts. Vaak komt er jarenlang geen rechter aan hun opsluiting te pas. En al zou er een rechter in het spel zijn, dan nog wordt “recht” gesproken in een Israelisch spel van Apartheid. Want de Palestijnen vallen onder militair recht en het is de Israëlische bezetter zelf die daarvan de spelregels bepaalt. Derhalve zijn ook deze mensen “gijzelaars” . Maar dan van de Israëlische staat.

Deel 2. De manipulatieve uitleg van een anti-apartheidsleus.

Ondertitel van Cook’s artikel: “‘From the river to the sea’ rejects not Israelis or Jews but the apartheid nature of Israel. This is why pro-Israel western politicians and media want to criminalise it.” 

Cook’s opiniestuk gaat verder in op het hardnekkige misverstand over de betekenis van de slogan die door velen nog steeds ten onrechte wordt gezien als een oproep om de Israeli de zee in te drijven. Het is evenwel de bedoeling van die slogan om vrijheid en gelijkheid (al zal broederschap echt te ver gezocht zijn) voor ALLEN te bewerkstelligen van de Jordaan rivier tot de Middellandse Zee.  Femke Halsema wil er niks van weten. De meerderheid in de Nederlandse Tweede Kamer ook niet. Dat geldt ook voor de meeste journalisten en publicisten in Nederland (zie bijv. Jan van Bethem, “Waarom de leus ‘Palestine free from the rivier to the sea’ een duistere betekenis heeft”, Nederlands Dagblad, 19 october 2023).
     Toch ligt er al lang een uitspraak van het Gerechtshof van Amsterdam in een Artikel 12 procedure van 15 augustus 2023, volgens welke de leus niet strafbaar is (https://rightsforum.org/niks-mis-met-slogan-from-the-river-to-the-sea-palestine-will-be-free-oordeelt-rechter/). Die uitspraak is de meeste mensen kennelijk compleet ontgaan.

Ook de Likud partij van Netanyahu zelf gebruikt de geografische aanduiding van de rivier tot de zee in hun handvest. Ik citeer:

“The Right of the Jewish People to the Land of Israel (Eretz Israel)

a. The right of the Jewish people to the land of Israel is eternal and indisputable and is linked with the right to security and peace; therefore, Judea and Samaria will not be handed to any foreign administration; between the Sea and the Jordan there will only be Israeli sovereignty.

b. A plan which relinquishes parts of western Eretz Israel, undermines our right to the country, unavoidably leads to the establishment of a “Palestinian State,” jeopardizes the security of the Jewish population, endangers the existence of the State of Israel. and frustrates any prospect of peace.”

Met de verklaring van de Likud partij dat “between the Sea and the Jordan there will only be Israeli sovereignty” wordt het recht op Palestijnse statelijkheid expliciet ontkend. De demonstranten die nu op straat de leus roepen, erkennen in feite de noodzaak om te werken naar een enkelvoudige staat. “They recognise that Israeli governments have already created a single state across the lands that were historic Palestine, and one in which different ethnic groups are segregated and accorded different rights.” De oproep is niet een van ethnische zuivering of genocide (waar de Israeli zich juist wél schuldig aan makenof, voor de hypercritici, “aan lijken te maken”), maar het is een oproep tot “a process of decolonisation – a dismantling of illegal settlements and the revoking of segregated rights – as happened with the end of white rule in South Africa. En het kan nog erger dan de Likud: Daniella Weiss, de aanvoerder van een prominente kolonisten-beweging, blijft volhouden dat het land dat door haar god aan het volk van Israel zou zijn beloofd, haar Eretz Yisrael, zich uitstrekt van de rivier de Eufraat tot de rivier de Nijl. Van dergelijke lieden hebben we dus nog veel meer ellende te vrezen.

[20:14 in TC van UN WebTV] Nada Tarbush: Thank you, Mr. Chair. Given that a number of states have spoken about Palestine directly, we have prepared three replies which we will read one after the other and we kindly ask for your indulgence in that regard. We will first respond to Israel’s statement. 

[20:35] Mr. Chair, at the outset, let us remind Israel that our name is not the Palestinian Authority, but the state of Palestine. Sure, your finance minister said at an event in Paris earlier this year there is no such thing as a Palestinian people. And your prime minister on the 24th of September held up a map at the General Assembly entitled “The New Middle East” in which Palestine was deleted and replaced entirely with Israel. 

[21:08] But if your government is annexationist and racist, this body is not. And we ask you to kindly adhere to UN protocol and nomenclature and to show respect to all stakeholders in this room. Let us also remind the Israeli delegate that the lack of rules of procedure for this meeting does not give carte blanche to lose all sense of decorum when speaking to interlocutors in this room. To the other states and civil society in the room, let me simplify Israel’s statement for you. 

[21:41] Other than throwing insults around and making grave baseless accusations, Israel said something that should make all of you shudder. It effectively said, “I can kill any and every person in Gaza. The 2.3 million people in Gaza are either terrorists or terrorists, sympathizers or human shields and are therefore legitimate targets.” 

[22:06] Every person, according to Israel, falls into one of these three categories. A child, a journalist, a doctor, a UN staff, a newborn baby in an incubator. And so, according to Israel, it can kill them and then have the audacity to come to this room and tell the world with a straight face, we are acting in international law. The death of each of the over 11,350 people killed over the past month, be it children, journalists, UN staff, the sick, the elderly, according to Israel, was justified. Think about that for a moment and let it give you pause. 

[22:52] Anyone espousing this warped logic has no shred of humanity, no sense of morality and no knowledge of legality. But guess what? Your carpet explanation for carpet bombing will not fly. People are not fools. The people in this room are seasoned diplomats who are well read, have a knowledge of history and many of whom have seen your government make the same arguments during your six previous military aggressions on Gaza in the past 15 years. They have seen you resort to collective punishment, targeting of Palestinian children, journalists, medical staff, aid workers before. They have seen you forcibly transfer our communities, colonize our lands, demolish our homes and evict families from their own properties since the 7th of October and for the 75 years that preceded it. They have seen your state-sponsored disinformation campaign before. Again, not fools. Don’t insult our intelligence. 

[24:10] By saying that it is acting in accordance with international law, Israel is effectively saying the UN Secretary General, the UN High Commissioner for Human Rights, the WHO, UNICEF, OCHA, UN Special Rapporteurs, the UN Independent Commissioner of Inquiry on the Situation, human rights organizations worldwide, disarmament NGOs worldwide, humanitarian NGOs worldwide, countless legal experts are all wrong. Everyone is lying about Israel violating international law and we are asked instead to believe Israel, the state that is actually doing the indiscriminate killing. It is interesting that by saying even wars have rules, Israel quoted the very same UN Secretary General, whose resignation it has called for, because he dared to say that Israel has a history of occupying Palestinian land. 

[25:15] The dissonance of hearing the Israeli representative talk about wars having rules as it commits genocide and breaches every rule in the book live on our TV screens is quite something. To Israel, we say, we see through your PR and disinformation. The whole world sees through your PR and disinformation. The millions of people filling the streets in every major capital of the world, calling you out for genocide, sees through your PR and disinformation. 

[25:52] Perhaps you think that with your incendiary rhetoric, we will all forget the incitement, the declarations and acts of Israeli officials, the people you represent, to wipe out Gaza, to drop a nuclear bomb on the Palestinian people, to destroy the “human animals” and “children of darkness”. Perhaps you think that your constant intimidation and threatening language will make everyone overlook the fact that Israelis, as we speak, killing babies, youth, women, men, elderly, no one too small or too old or too sick to be spared its wrath. Perhaps you think that by cutting off telecommunications and imposing yet another blackout on Gaza, you can continue to commit genocide while avoiding the annoyance of people being able to use their phones and computers to report on it. Perhaps you think that as your trigger-happy soldiers continue to kill journalists, 41 so far, the highest number of journalists killed over a four-week period than in any conflict in the last three decades, you think that no one will be left to expose your crimes. Perhaps you think that by trying to silence anyone who tries to speak about your crimes, the international law violations of the state, by calling them either anti-Semites or terror supporters, people will be silent. And your intimidation campaign knows no bounds. 

[27:30] They attack Palestinians, Jews, Israelis, U.N. officials, politicians, parliamentarians, university professors, and anyone worldwide who calls you out for your violations of international law. But guess what? Your intimidation and silencing will not work. We, along with all peace-loving nations and along with all people of conscience around the world, will not be silent. We will continue to call you out on your crimes to call for accountability for your violations, for sanctions as your government continues to reject calls for a ceasefire, to massacre our people, and to entrench your colonial occupation and apartheid regime. 

[28:18] Something your country should have learned over the past 75 years is that the Palestinian people are a people who refuse to disappear. And your nuclear threats, and your bombs, and your tanks, and your bulldozers will never break the Palestinian people’s will to be free, and to live in the dignity and peace to which all people are entitled. Unlike you, we have consistently stood in this forum calling for respect for international law, for ethical principles to guide state behavior, for peace over war, for humanity over national interests, for disarmament over destruction. Once again, we stand in this forum to call on all states to respect and ensure respect for international law. Let the law be the measure by which all are judged, not propaganda and hateful, biased, spin steeped in racism. [29:18] And to Israel’s absurd assertion that Palestinians have a problem with people of Jewish faith, and give the impression that this is a religious conflict, let us say it loud and clear, this is not, and has never been about religion. 

[29:35] Had the occupiers of our land, or the violators of our rights been Muslim, Christian, Buddhist, Hindu, atheist, or of any other conviction, we would have called them out all the same. Palestine has always been multi-racial, multi-ethnic, and multi-religious. People of Jewish faith have lived in historic Palestine as Palestinians for centuries. 

[30:04] We consider them to be our brothers and sisters. And since the memory of the Holocaust has been invoked, let us also say loud and clear, we have the greatest of solidarity with both the victims and survivors of the Holocaust. [30:15] It was not Palestinians that committed that horrific genocide, but the fascist forces that spawned from Europe. And it is unconscionable that a number of European leaders are again beating the drum as another genocide is now underway in Gaza. We are united with those hundreds of thousands of Jews around the world, including from organizations like Jewish Voice for Peace, If Not Now, Na’amud UK, who are calling out this genocide and chanting in the streets of New York, London, Paris, Berlin, Sydney, Toronto, and all major western cities so that their governments can hear, “Not in our name! End the genocide in Gaza!” With them, we stand together to end this pain and suffering. Together, we will not allow this to happen. Never again is now.

[31:18] Now in response to the European Union, and states that claimed that Israel is acting in self-defense in Gaza. …

[32:07]  So, In response to the European Union, and states that claimed that Israel is acting in self-defense, I am now convinced there is another International Law that we don’t know about. That the European Union, Switzerland, the United States and others are referring to when they use the term «self-defence» to descibe the commission of war crimes and crimes against humanity at scale. One that allows collective punishment, indiscriminate attacks, wanton destruction, racial discrimination as long as your name is Israel. They just forgot to teach us this law in high school. That is why there is such a misunderstanding between us. 

      [32:43] When they say that Israel has a right to «self-defence» in Gaza, perhaps they would like to define their use of the term for all in this room. [32:53] Are you saying that dropping the equivalent of two nuclear bombs over the heads of 2.3 million people in one of the most densely populated areas on earth constitutes «self-defence»? Is destroying over 50% of all civilian infrastructure «self-defence»? Starving civilians, imposing a medieval siege, forcibly displacing millions of people, killing UN Staff, is this «self-defence»? [33:16] Do your governments feel no shame using language intended to justify the killing of thousands of children? So let me correct it for you: carpet bombing an occupied, besieged, colonised population with the latest military technology is not «self-defence». [33:33] It is genocidal aggression. And we encourage your governments to seek legal advice before making such statements. [33:39] Under international law, an occupying power does not have the right of «self-defence» against the territory it occupies. [33:35] And I refer you to paragraph 139 of the ICJ Advisory Opinion on the Wall. 

     [33:55] Now, to respond to signatories of the political declaration on EWIPA [= Explosive Weapons In Populated Areas] who did not…. who spoke about the need to uphold the declaration under all circumstances but could not get themselves to say a single word to deplore, condemn or at least express concern about the use of explosive weapons by Israel in Gaza. We have a few words for you. [34:21] For the past month, Gaza has been subjected to the most sustained and intense bombing campaign of a populated area in history. Let me just say that again: Gaza has been subjected to the most sustained and intense bombing campaign of a populated area in history. Amid the bombs, the sound that rings the loudest is the silence and even encouragement of the use of EWIPA by Israel’s allies. Many of whom were at the forefront of advocating for this political declaration. [34:57] Instead, they continue to support Israel’s actions, whether diplomatically, politically or militarily, enabling it to continue the use of EWIPA and egregious violations. [35:07] You know, as we do, that had this been happening in a different part of the world, you would have been horrified, you would have jumped to impose sanctions. Imagine if a hospital in the United States had been hit with explosive weapons killing patients, doctors and staff, or if a church in Europe sheltering homeless refugees was bombed. Any single one of those crimes would have caused you outrage, and they should. Yet all of them happen in Palestine in the span of a few weeks and you are unmoved. [35:39] The Austrian government here deserves especial mention. For years, Austria has been at the forefront of initiatives and efforts of EWIPA. We believed genuinly that Austria was a champion of the declaration. But when push came to shove, and Gaza is facing the most sustained and intense bombing campaign of a populated area in history, the Austrian government was one of the very few states that decided to vote «No» on a General Assembly Resolution calling for a cessation of hostilities. In its statements yesterday, Austria did not condemn Israel’s actions, flauting Austria’s own proclaimed values, but was very quick to condemn the alleged use of hospitals for military purposes with not a single shred of evidence to make that claim. [36:23] Indeed, as Human Rights Watch noted, Israel has put forward no evidence that would justify stripping hospitals of their special protections under IHL [International Humanitarian Law]. This statement therefore clearly emanated from political rather than legal considerations. 

     [36:38] Other states also deserve a special mention. The United States just said that it believes that the political declaration, quote, «helps states to do critical work to help improve the protection of civilians in armed conflict». How could they be saying this, when they themselves are not implementing their commitments under the declaration when it comes to Gaza? [37:02] Had the United States, Israel’s main ally and supporter, ordered a ceasefire seven day ago, a thousand-five-hundred more Palestinian children would still be alive. Had it ordered a ceasefire fourteen days ago, another three-thousand Palestinian children would still be alive. This is a huge responsibility. 

     [37:22] But even more horrifying than that, the United States, the UK, Canada, Germany, Italy and The Netherlands, all of them signatories to the political declaration [of EWIPA] have continued their supply of arms and military support to Israel. Sending more explosive weapons to Israel is not exactly the best way of implementing your commitments under the declaration [37:46] Besides, arms transfers to Israel as it pummels Gaza with explosive weapons could render government officials individually criminally liable for the role in aiding and abetting war crimes and crimes against humanity. And indeed a number of NGO’s have formally notified  politicians of relevant countries of their intention to prosecute.

      [38:05] You all spoke about your concerns for the humanitarian situation in Gaza but this humanitarian catastrophy is not the result of an earthquake or a natural disaster. It is the result of a deliberate genocide, supported militarily by some of the states represented in the room. And you have the power to stop it and you choose not to. 

     [38:25] It would be in the interest of no-one for double standards to lead to discrediting the political declaration on EWIPA. The Palestine Question remains a litmus testfor the viability and efficacy of international law. Oscar Nominatie voor IDF films?

De Israeli zijn het Al-Shifa ziekenhuis binnengedrongen. Ze hebben flink om zich heen geschoten, ook met drones, terwijl er geen berichten zijn van verzet. Het ziekenhuis is nu een huis van bewaring. Maar zonder rechtsbescherming. Want de Gazanen die zich daar in veiligheid hadden gebracht worden ruw mishandeld, soms van kleding ontdaan en geboeid afgevoerd naar onbekende plaatsen. Van medische behandeling of zelf maar consideratie is geen sprake. Sterker nog, de laatste voorraden medicijnen en instrumenten zijn door de Israeli vernietigd. Het lijkt er ook niet op dat er babyvoeding is binnengebracht voor de stervende babies. Maar de Israeli zijn wel snel begonnen aan het draaien van een speelfilm. Volgens de NGO Euromed, The Euro-Mediterranean Human Rights Monitor, een NGO gebaseerd in Genève en geassocieerd met Richard Falk (voormalig VN Special Rapporteur), lijkt het Israëlische aanvalsleger bezig te zijn om in het ziekenhuis opnames te maken voor propagandafilms. Het zou me niks verbazen als die films vanavond in de Nederlandse nieuwsprogramma’s in premiere zullen gaan.
PS. Ik wil nooit meer iets van Rutte horen. Of het moet tijdens een zitting van het Internationaal Strafhof zijn. Dan mag hij dáár achter Israel gaan staan.

Gisteren maakt ik melding van het vermoeden van de NGO Euromed dat het Israelische leger wel eens een video zou kunnen gaan produceren met de bedoeling om hun aantijgingen tegen Hamas te “bewijzen”. De verwachte video van het IDF (lees” IOF”) is inmiddels in premiere gegaan, als “one-shot” video, “starring” de reservist Jonathan Conricus, en gepubliceerd door het aanvalsleger zélf op dit address: https://www.youtube.com/watch?v=hEhsIJUw1DQ

De reservist toont ons hoe hij het gebouw binnentreedt en wat ze, naar eigen zeggen, binnen hebben aangetroffen. De CCTV camera’s waren afgeplakt, hetgeen veelzeggend zou zijn. Verder toont hij “go-to-bags”, zogezegd van Hamas strijders die soms leeg zijn en vaak nog gevuld zijn met o.a. stukken van persoonlijke uitrusting (kistjes, kogelvrije beschermingsplaten, handgranaten, AK-47s, patroonhouders etc.). Een enkele keer “in situ”, volgens Conricus, en in een ander geval op tafel gesorteerd voor demonstratiedoeleinden. Zo zou er ook een laptop met belastend materiaal zijn gevonden (werkend, kennelijk zonder password of ander s door een slimme IT-reservist kennelijk ter plaatse gekraakt. Wat de vindplaatsen betreft, die zijn nadrukkelijk geassocieerd met medische spullen: een paar wapens liggen op schappen tussen de dozen met verplegingsmiddelen. Twee “go-to-bags” zouden zijn verstopt achter de magneten van de MRI scans. Smalend merkt de gids op dat eromheen grote hoeveelheden “medical supplies” in plastic zakjes liggen en dat er “dus” helemaal geen sprake is geweest van een gebrek aan medische spullen (een “huilie-huilie” verhaal in zijn ogen dus waar hij belooft later nog over verder te gaan). Er worden geen bloedsporen of gesneuvelde Hamas strijders getoond. Evenmin is er sprake van dat tunnelcomplex van Hamas dat zo prominent was “gevisualiseerd” in de 3D animaties van het IDF. Dat is allemaal kennelijk niet aangetroffen. Alles wat we hebben gezien zijn draagbare ‘items” die stuk voor stuk (per “go-to-bag”) in die dozen hebben kunnen zitten die het leger zelf gisteren het ziekenhuis in hebben gebracht met de opzichtige Doe-Het-Zelf printjes in A4: “Medical Supplies”. Alles bij elkaar lijk ik in de “bewijs-video” niet meer dan een dozijn kleine wapens te hebben gezien. En die kunnen gemakkelijk zijin neergelegd, al bezweert de reservist, zonder argument, “so please don’t give me any of that «you open it up and you place it there»” (tijdcode ca. 05:52). Tegen het einde van de zogenaamde “one-shot” video, die nogmaals zelf door het Israelische leger is gepubliceerd, zien we een klaterend duidelijke schnitt in de video, op TC 06:26 (hetgeen ook reeds is gemeld door o.a. Mondoweiss: https://twitter.com/Mondoweiss/status/1724888025828561116). Dat is vlak voor ze de inhoud van de tas tonen die een laptop bevatte en een walkie-talkie. Tot zover het beruchte Hamas-commandocentrum waarvoor duizenden mensen moesten kreperen in een ziekenhuis waarvan de uitgangen werden afgedekt door Israelische sluipschutters.
Gisteren al heeft de internationaal-rechtsgeleerde Ardi Imseis (Queen’s University, Ottawa) via videoverbinding op Al-Jazeera gewezen op het feit dat woordvoerders van het IDF en de staat Israel “gewoon zijn” om onverifieerbare “bewijzen” aan te voeren om hun gelijk te betonen. Hij verwijst daarbij naar onder meer The Goldstone Report (waarvoor zie Norman G. Finkelstein, Gaza. An Inquest into its Martyrdom, University of California Press, Oakland, California 2018). Hun meest klunzige kunstwerkje in de fabricatie van bewijs van deze week was volgens hem toch wel de demonstratie van een kalender aan de muur in het Rantisi ziekenhuis die een lijst van strijders zou bevatten: de namen van de weekdagen werden daar ten onrechte geïnterpreteerd als de persoonsnamen van Hamas-strijders. Hierop is in de sociale media evenwel weer antwoord gekomen van pro-Israelische zijde, waarbij de aandacht wordt gevestigd op het feit dat de muurkalender begint op 7 october, dat de kalender de titel zou hebben gedragen van de uitbraak-operatie, en dat een vertaalfoutje betekenisloos zou zijn: https://www.reddit.com/…/the_calendar_used_by_hamas…/). Professor Imseis wijst er terecht op dat er voldoende gelegenheid is geweest voor het IDF om internationale waarnemers mee te nemen, zoals mensen van het Rode Kruis die, volgens Imseis, zeer wel bereid zouden zijn om dat te doen. Het feit dat Israel de waarnemers toegang weigert, is op zich natuurlijk oook al verdacht.
Zelf wijs ik op de klungelige montage van de beelden die door Israelische bronnen werden aangeleverd met de bedoeling om het bombardement op het Al-Ahli Baptist Hospital in Gaza van 17 october te wijten aan een afzwaaiende raket van de verdedigers in Gaza: de video toont opstijgende raketten, Qassam raketten waarschijnlijk, waarvan er eentje in de lucht reeds ontvlamt en dan zou zijn neergekomen op het voorterrein van het ziekenhuis: maar de explosie zie je in een ander shot; er is een probleem met de “time stamp” van een van de video’s (waarbij ze er 40 minuten naast zitten); het audio blijkt na Brits onderzoek te demonstreren dat de raket of bomvan een andere richting kwam; en het gebrek aan een inslagkrater, dat werd aangevoerd als “indicatie” van een ontploffing van raketbrandstof in plaats van een bom uit een vliegtuig of een stuk artillerie, is eenvoudig te weerleggen, als bewijs, door te wijzen op het mogelijk gebruik van ‘proximity fuse’ bommen. Trouwens, als we in het ene shot zien dat de raket ontplofte en om die reden zou zijn afgezwaaid, hoe kan die dan nog genoeg explosief materiaal hebben gehad voor die fatale explosie op de grond? Kortom: flauwekul.
Het is tenslotte nog wel relevant om te melden dat de paar uitingen die ik vanmorgen van de Grote TV Media (NOS, RTL) heb kunnen beijken, niet hebben gewezen op het feit dat er een duidelijk zichtbare montage-schnitt zit in de video waarvan ze beweren (en doorpompen) dat die een “one-shot” video zou zijn. Evenmin is er gewezen op het mogelijke verband tussen de binnengebrachte dozen met de stickers “Medical Supplies” (volgens de lezing van Israeli: https://www.timesofisrael.com/…/idf-medical-supplies…/) en de getoonde vondsten van draagbare items (rugzakken, kleine wapens) die als belastend materiaal voor Hamas zouden zijn gevonden. Het gebrek aan sporen van daadwerkelijke gevechten met Hamasstrijders wordt evenmin genoemd. In de sociale media zien we de afgelopen weken honderden zo niet duizenden geplaagde Gazanen en in géén geval zie ik temidden van die beelden gewapende mensen. Dat zien de nederlandse journalisten niet. Die staan in Tel Aviv bij de persconferenties en laten zich door Israelische fixers verder rondleiden.

Ten slotte, voor vanmorgen, wijs ik ook nog op de observaties van de Noorse arts, Mads Gilbert, die het Al-Shifa ziekenhuis goed kent uit eigen werkervaring.

De interviewer vraagt aan dr. Gilbert wat zijn reactie is op de beschuldigingen van de Israeli dat het ziekenhuis zou zijn gebruikt door Hamas (dus als schuilplaats, militaire basis, wapenopslag of commandocentrum). “DR. MADS GILBERT: Twofold. Why are you in the media conveying these false claims continuously and taking the attention away from what is the real problem — namely, the continuous bombing and killing of people in Gaza? There is absolutely no proof, so far, that I know of, neither from U.S. intelligence nor from the Israeli intelligence, and we’ve heard these accusations for 16 years. Show us the proof. Show us the evidence. And don’t forget that the Geneva Convention, the Fourth Convention, is telling the fighting parties to make both distinction and precaution. If it’s a mixed military and civilian target, the civilian precaution takes priority over the military again. And they have been bombing not only Shifa and al-Quds, but lots of hospitals, with even bothering to claim that there is any military activity in that hospital. They bombed the Turkish. They bombed Al-Rantisi Pediatric Hospital. And we’ve all seen these ridiculous videos where they say, “Oh, here are Pampers in a pediatric hospital. It’s got to be the terrorists.” So I think this is a big sham, and I’m a bit worried that you in the media so easily are conveying these unsubstantiated accusations. Laat de politici –– Rutte, Yesilgöz maar net zo goed Timmermans en van hem af gerekend zéker iedereen op rechts –– er ook maar rekening mee houden dat, indien het element van zelf-verdediging voor Israel wegvalt, wij ook niet meer bijstand mogen leveren in termen van geld en wapens. Dan zouden ‘we’ immers medeplichtig worden aan de genocide die momenteel door Israel wordt bedreven. [Niet in mijn naam! Niet met mijn goedkeuring!] Evenmin zouden we schepen ter bijstand bij evacuatie moeten sturen, want dan zouden we medeplichtig worden aan de ethnische zuivering en verdrijving van de inheemse bevolking –– doet me meteen denken aan Smyrna 1922! Israel voert geen oorlog tegen Hamas want deze racistische “settler colonialist” natiestaat is bezig een hele burgerbevolking uit te moorden. Het gaat immers om “carpet bombing”, dus om “indiscriminate killing”. Het argument van het “menselijk schild” gaat dan ook allang niet meer op. Zeggen ze dat ze doelen van Hamas op de korrel nemen? Dat er een Hamas strijder zat in dit of dat gebouw? In die ambulance? Ze wisten het afgelopen jaar niet eens dàt er Hamas-strijders echt actief waren, laat staan wie, wat waar. Toen hadden ze zéker nog maximale controle maar tastten ze toch in het duister. En dan zouden ze nu precies weten waar ze op moeten schieten? Flauwekul: ze willen de druk opvoeren om de genocide die zeker vanaf 1948 is begonnen snel voort te zetten. Ze maken van de gelegenheid nu graag gebruik om de klus af te maken, zo blijkt uit een gelekte stuk van hun militaire Think Tank, waarin gepleit wordt voor ethnische zuivering: «there is need for an immediate viable plan for the resettlement and economic rehabilitation of the entire Arab population in the Gaza Strip, which sits well with the geopolitical interests of Israel, Egypt, USA, and Saudi Arabia. […] In 2017 it was reported that in Egypt there were 10 million available apartment units of which half were built and half under reconstruction. Weer zo’n briljant juridisch stuk, deze keer van een rechten-faculteitslid van de Universiteit van Londen, Ralph Wilde. Echt verhelderend omdat het ook meteen demonstreert dat en waarom de bezetting al 65 jaar lang illegaal is. Want Israel’s preventieve aanval van 1967 had geen geldige oorlogsreden. De hele oorlog van 6 dagen was illegaal. De bezetting die er uit is voortgevloeid is derhalve ook illegaal. De Palestijnen hebben op grond van het recht op zelfbeschikking het recht om zich te verzetten, ook met geweld, tegen die bezetting. Natuurlijk moeten ze daarbij wel de regels van oorlogsvoering respecteren. En dat ging fout op 7 october, doch alleen gelet op individuele misdaden, maar niet op de uitbraak zélf. Het is ook verkeerd om de uitbraak van 7 october te beschouwen in isolatie (dus wat nou, “geen ja-maar?”). Het was slechts een moment in een langslepende strijd tussen bezetter en onderdrukte. En schokkend moment dat een meervoud aan parallellen heeft in overtredingen aan de andere zijde vanaf 1967, nee, vanaf 1948, nee, vanaf 1940 (de Bende van Stern, Lehi), 1931 (Irgun Zvai Leumi), of eigenlijk al vanaf 1920 (Jabotinsky’s Haganah). Hoe dan ook, Israel kan zich in deze hele affaire niet beroepen op het recht van zelfverdediging: want de huidige escalatie is precies dat, een escalatie van een lopend proces dat steeds meer de verklaarde intentie heeft van landjepik, verdrijving, verdrukking, ethnische zuivering of, zoals steeds openlijker blijkt genocide.
Noot tussentijds: Zelfs D66-er Sjoerdsma, inderdaad, die op 17 october tegen de motie Stoffer [21501-02, nr. 2729] heeft gestemd: “Duidelijk is dat D66 Israëls recht op zelfverdediging steunt [SIC.], dat geen cent van de Nederlandse hulp bij Hamas terecht kan komen en dat Israël medische steun verdient. Maar we moeten niet selectief zijn. Wanneer Israël het internationale recht schendt, collectief straft of Gaza blokkeert, dan moeten wij dat ook veroordelen. Vergelijkbaar betoog in een eerdere fase waarin Gazanen werden gedood door sluipschutters omdat ze te dicht bij de hekken en muren van het concentratiekamp kwamen: ” It is a tenet of law that no rights can be derived from illegal acts (ex injuria non oritur jus), and it is obvious that a right to self-defense does not obtain in all situations. A rapist cannot claim a right to self-defense if the victim pummels him. A theater owner has no right to self-defense if patrons attack him after he sets the building ablaze and impedes their flight. Weer een verklaring, waarschijnlijk van 7 november 2023, van professor Ardi Imseis, een rechtsgeleerde aangesloten bij Queens University Canada. Een heldere uitleg met verwijzing naar een relevante “advisory opinion” van het International Hof van Justitie over de kwestie van “de muur” (Paragraaf 139) uit 2004, waaruit blijkt dat Israel geen beroep kan doen op zelfverdediging tegen aanvallen die “voortkomen uit” (“emanate from”) gebieden die Israel ten onrechte heeft bezet. Gaza kwalificeert (ondanks de terugtrekking van troepen en kolonisten o.m. vanwege de blokkades, de rantsoenering en de ingrepen). Tegen een fysieke aanvaller tegenover je, mag je je op dat moment verdedigen, maar je kunt niet beweren dat je je op 8 october verdedigt tegen een aanval op 7 october. Francesca Albanese waarschuwt allang heel consequent voor de steeds verslechterende situatie op de Westoever en Oost-Jerusalem. Het is, in mijn eigen woorden,  alsof de Israeli proberen ook daar een escalatie te forceren in het kader van hun genocidale plan.

Ik citeer een paar interessante passages (mijn transcriptie) waarbij ze meer specifiek ingaat op de situatie in de voornoemde gebieden.

[18:44] “[T]hese tragic hours are not limited to Israel and Gaza. There are 60 people who have been killed in the past days […] in the West Bank [let wel, dit is sinds 18 october enorm toegenomen]. I don’t know if this […] killings also took place in Jerusalem. I personally do not know, but they have taken place at the hand of settlers, settler violence. And it, really, it’s in my experience at this point, […] just semantics, distinguishing the […] settlers from […] the soldiers, because they go hand. The soldiers are there to protect the settlers. They are no two separate entities.”

[19:19] “So there is a responsibility on Israel to […] abide by international law. Israel is still an occupying power.  I know that many in this country [USA] struggle to register this,  but the West Bank including is Jerusalem and Gaza are occupied under international law. And it’s an occupation which operates squarely outside what is permitted by international law.  In fact, in my view, and in the view […] of many international law experts, it’s illegal because it has translated…It has operated as a vehicle to colonize occupied land, which is a clear violation of article 49 of the Geneva Convention. Which is also violated by the transfer of Israeli civilians into occupied the territory.”

[20:31] “And […] there is a lawfare: Israel uses […] international law arguments to […] claim that it’s acting in self-defense. Look, I will not challenge ever Israel’s right to protect its citizens. Israel’s right to defend itself. But Israel cannot confuse, and to act in the name of its security. But Israel confuses its own security with the security of its annexation plan over the occupied Palestinian territory. Because this is what’s been happening over years. […] This is not the outcome of the arrival to government of extremist elements. It has been there since […] many years. […] And there’s been a legal dualism. So the Palestinians are under military law, law that is written by soldiers applied by soldiers who consider themselves […] in a situation of hostility with the occupied population; and then […] Palestinians are […] judged on the ground of this in military courts, including children as young as 12. It’s, it’s, really, it’s a unique situation in the world, because military courts shouldn’t be trying civilians, [they] are deemed unfit to try civilians.”
