In het kader van de stervensbegeleiding van het internationaal recht vestig ik de aandacht op de (ge-)dode letter van Resolutie 2417 van de Veiligheidsraad.

Op 24 mei 2018 is door de VN Veiligheidsraad een resolutie aangenomen die mede door Nederland, de toenmalige tijdelijke voorzitter, was ingediend en waarin zowel de belemmering van humanitaire hulp als de vernietiging van bestaansmiddelen als oorlogsmisdaden worden veroordeeld (uiteraard ter herbevestiging van reeds gevestigde bepalingen, o.m. door de Geneva Conventies van 1949 de Aanvullende Protocollen van 1977); in de resolutie van 2018 is bepaald, nogmaals, dat alle lidstaten zich moeten inspannen voor de handhaving van het recht op deze punten. Nederland had dat ingediend maar houdt zich MOMENTEEL totaal niet aan de bepalingen!

“1. [De Veiligheidsraad] Recalls the link between armed conflict and violence and conflict‑induced food insecurity and the threat of famine, and calls on all parties to armed conflict to comply with their obligations under international humanitarian law regarding respecting and protecting civilians and taking constant care to spare civilian objects, including objects necessary for food production and distribution such as farms, markets, water systems, mills, food processing and storage sites, and hubs and means for food transportation, and refraining from attacking, destroying, removing or rendering useless objects that are indispensable to the survival of the civilian population, such as foodstuffs, crops, livestock, agricultural assets, drinking water installations and supplies, and irrigation works, and respecting and protecting humanitarian personnel and consignments used for humanitarian relief operations;”

Een van de bepalingen over de verplichting van verdragspartners:
“8. [De Veiligheidsraad] Urges those with influence over parties to armed conflict to remind the latter of their obligation to comply with international humanitarian law;”
